challenging fixed penalty charge

Since I can't search, I don't know if this has been asked before...

I received a notice for illegal parking in a town I rarely visit and on the date in question the car wasn't even in the area. I can prove that the only two drivers were over 60km fro the location and the vehicle in question was actually parked 30km away...

Does anyone know how I should go about challenging this fine, should I let it go to court? I've already lodged an appeal to the Superintendent of the station neraby.

If you have gone to the Superintendent the Gardi will look into it. I presume it was a Garda that issued the ticket rather than a traffic Warden. The Garda that issued the FPN can check the details they recorded against your car registration. If the details don't match (as in a typo on the reg no) I presume the FPN will be cancelled. If they match either your car as been cloned or it was there.

Thanks, I know for a fact it wasn't there unless someone cloned the electronic key and left it back at the railway station afterwards.. I also now understand that there are cctv cameras in that location...I wonder how hard it will be to get footage for the day in question... I intend to take this to court if necessary, hopefully its just a typo on the docket.

Any update on this? I just received a fixed charge in the post (first and only) alleging I was parked in a loading bay on Marine Road, Dun Laoghaire on the 3rd last month.

I was not in Dun Laoghaire that day, nor have I ever parked on marine road.

Will I bother to appeal this? I have no evidence to claim I was not in Dun Laoghaire at the time. I'm thinking it might be easier to just pay the €40. Pisses me right off though, because I'm paying for an offence I did not commit.

Wardens in Dun Laoghaire take photos when issuing tickets so it should be easy to sort out if it was a mistake.

This came from the guards though, not the council. Does that make a difference?

However can you both be sure you did not at some time park in the area in question? Both locations are near to where the vehicle is situated, why not 200 miles away? Not that i'm saying your lier but could it be a honest mistake on your part no offence inteded. Possibly you may have park there on a different day?

That I don't know. I'd ring them and ask, i'm sure they'd have a record of the make/model/colour, if that doesn't match then you're in luck.

Last Friday I got a FPC notice for parking on a double yellow and not displaying a tax disc, in Navan. Small problem for the garda that issued it, I was at work in Clare at the time, and can prove it with time/date stamped photos. Was going to say screw you, but after reading posts here will most likely try the superintendant route.

No option on the notice to state it wasn't me or my car
