cancel timber frame

    hi,

    i have had the most stressfull 4 weeks of my life, starting off with my builder falling off the face of the earth the day before he was supposed to start (no deposit give).
    the timber frame company we were dealing with have now insisted in an undertaking from our solicitor saying that he will pay the balance of the funds on delivery no matter what!!!!
    our solicitor has said he can issue a letter saying that the funds will paid when released from the bank etc. we are planning on paying 60% upfront and the balance on completion and signoff, but this isnt accecpable with out the undertaking letter from the Solicitor.
    the TF company will not budge on this and we have been back and forth with them trying to come up with a solution. me and my partner and solicitor are at are wits end with them and are now planning on cancelling the whole contract and going traditional build..
    what the hell ever happened to a contract between company and client???
    has anyone had something similar with a TF company???
