Summoned to district court

    Hi
    Just wondering has anyone else had experience of the following, and what was the outcome? Forgot to pay a fixed speeding fine and it was too late when I remembered and was summoned to the district court. I was ready to take my 4 penalty points and fine, but my name was never called. Checked the court list and my name was not there. The guard involved in my case said that he was finished in court for the day. Checked dates and location. As I was very nervous being in court I forgot to ask what happens next? Will i be called again do you think? Or is that the end of it. Anyone in same position

    Check your record number or file number on the summons you received. Ring the District Court office quoting the number for your area and ask them what happened on the day. You could also check with the Garda in question.

    If you case was entered and you missed it then the court can convict in your absense. You may have been fined and if so 4 penalty points apply automatically.

    PS: Be sure to find out ASAP because if you dont pay the fine the judge handed down you may end up in prison!:eek:

    Presuming you were present in court so as to confirm that your case was definitely not called (and if not on list that is likely but those printed lists are not definitive as to what cases are before the court) what happened here 99.9% likely was that the garda returned court documents to close to the return date to allow the case to be listed.

    In a general sense it would be unusual to be hauled back in and would require you to be cautioned in person as to the date of the hearing or to receive a further summons.

    I would forget about it unless I heard anything more about it. Based on your conversation with the garda I don't think it likely you will.

    You could do this, but to put your mind at ease, ring the District Court office and find out what happened.

    Something similar happened to family member, fine came in the post after a while, he thought his case was not listed. His lack of court room experience and nervousness were both factors.

    Plus if you do have a penalty points you probably have an obligation to tell your insurer!! If you dont they could refuse to pay out in the event of an a claim being made against your policy.

    Thanks for the replies everyone. No, my case was definitely not called as I was talking to the guard in question and he checked my summons and court list and his list. He told me he was finished for the day and to go home. I was so nervous and worried that I was delighted to get home. I think I might ring the court to see what happens next.They might put me on the list for the next court day? I don't want this hanging over me. Thanks again
