Unlawfully fired???

    I just want to know if the manner in which i was let go warrants legal action.

    I have been working in a business for the past 4 months. Anyway, one night i fell down the stairs of my house and tore the ligaments in my ankle. Due to work the following afternoon i called in as early as I could to tell my boss I couldnt make it.

    Since then I have not received any more hours in work, despite calling repeatedly telling them I have recovered and am fit to return.

    Im not officially unemployed yet, but if i was told that I was to be let go, would I have any rights in the matter??

    Under the Unfair Dismissals Acts an employee must have been in continuous employment for 12 months in order to acquire any rights thereunder. Meaning that, save in certain exceptional circumstances, an individual cannot be unfairly dismissed until they have at least 12 months service.

    plus as you say that you are not being given any more hours I'm led to believe that Unfair Dismissals legislation is unlikely to apply to your position as it seems quite casual.

    The employee's rights legislation aside from that stuff is hugely technical however and you'd be mad not to talk to somebody appropriately qualified. Particularly as time limits for claims are very rigid.
