    Can you be given an adult warning from a guard for saying thats F ing stupid to a lollipop lady ?

    You can be given one for
    • Harassment or [FONT=&quot][/FONT]
    • Significant or persistent alarm, distress, fear or intimidation or
    • Significant or persistent impairment of their use or enjoyment of their property.

    I suppose doing what you did could be considered as one of the above.

    Leave the Lollipop Lady alone! She's only doing her job.

    adult caution sorry. its very strange that you can get in trouble for cursing sure at that rate everyone would be on it. i had a reason to say it so i think il refuse the warning n go to court

    lol. was dropping of a child outside a school. Child has Autism I admit i parked in the clear way to allow him and his mum out as soon as they got out i drove of but this lollipop lady was shouting you should not have stopped there etc i just said sorry but the kid has autism then tried to explain and she kept talking over me so i then said well thats fing stupid exactly one month to the day i get a call from a guard telling me to go to the staiton. I go in and they said i will be recommended to the super to get an adult caution LoL its bloody hilarious tbh

    ps if anyone on this forum slags me anymore im going to report them and get a caution LOL

    as far as I know Autism is a mental disorder, not a physical one, so parking there on grounds of disability (which it sounds like you were getting at since you mentioned autism) isnt exactly warranted is it, more an excuse rather than a need.

    well for someone who didnt know this about the child i thought i was doing right by stopping there putting the hazards on letting the child and mother out safely and close to the school. I dont know anything about disorders so I thought I was doing right and I stand by what I did when it came to the child. I didnt park there for more than 30 seconds

    Sounds like you committed an offence under section 6 of the criminal justice public order act 1994, people are entitled to go about their business in a public place without people swearing at them.

    I'd also say the caution is your best bet as no judge is going to accept you swearing at a lollipop lady when kids are going to school.

    You seem to think by shouting Autism that you can flaunt the rules & get away with it. I don't. The Lollipop Lady doesn't, the Gardai don't, the Judge won't - but you do, so that's ok.

    who shouted autism? I never made an issue of it to the woman i simply tried to explain.
    i panicked with the kid god sake give a guy a break. it was the first time to ever experience anything like that with the kid and a disability.

    I have already said to the garda in question that im sorry and explained about the problems during the journey but found it a bit harsh for this to be said to me at the end of it

    Basically its your first and last strike,the gardai will keep a record of the caution but its not a conviction so you've no criminal record as such.

    I take it you mean the non-statutory Adult Caution scheme and not the ASBO type stuff.

    The Adult Caution Scheme is operated in circumstances where a person has no or insignificant criminal convictions, the offence alleged is minor and non-violent and crucially, they consent to receiving the caution. So no matter what you do it can't be applied to you unless you agree.

    In a general sense telling someone to fup off could constitute a breach of the peace contrary to common law or s. 6 of the Criminal Justice Public Order Act 1994, or offensive behaviour (outside certain hours or if requested to stop by a garda) contrary to the s. 5 of the same act.

    Bottom line...whether you are offered the scheme is totally up to the gardai, whether you agree to accept caution is totally up to you. If you don't accept the offer of a caution, in most circumstances you are instead charged with the appropriate offence.

    This is exactly what the Garda is trying to do!

    You have to meet him half way by accepting the caution, otherwise you'll have to take your chances in court, but bringing Autism into the equation, or your lack of knowledge on the condition, will not help you!
