Santas and previous convictions

    Hi

    I guess this might not be the correct forum for this question, but don't know where to ask it!! It is a HR question.

    I am running a recruitment drive for Santas, thus successful applicants will be dealing with children.

    So my question is, can I ask the following on a job application:

    Have you ever being convicted of an offence in the Republic of Ireland or elsewhere? If yes, please give details.

    Any thoughts or direction would be appreciated.

    I'd imagine that your questionnaire could be similar to that used by a good creche or play-school. So I see no issue. But even if the question is included, can you be sure that a guy who had convictions where kids were involved would tell the truth? I'd suggest you go to the local Gardai and see if they are able to / allowed help you out with background checks.

    Yes ofcourse, Have your ever been convicted of a criminal offense is a standard question in an interview. Similarly i'd be asking if they use any non-prescription drugs - as this would effect their work.

    When it comes to working with kids you need to be really really careful who you hire.

    If its only for a the short Christmas period it might be worth using a temp agency - I know that Adecco Recruitment actually have a branch that can hire Santa's - as in the staff with the full santa gear. PM me and i'll send you a contact for the Manager.

    Anyone who works with kids has to undergo Garda vetting I think. I worked with a secondary school musical and everyone had to get it done, even me and I'm only left the school.

    "Non-prescription drugs" covers anything from Anadin to Heroin - you might want to reword that question.

    Maybe but you can OD on non-prescription medicine like over the counter pain killers if you take enough. Wasn't meaning to be specific about the wording just the point that you need to be sure you'd leave your own kids with the person if your planning on letting them near other peoples kids.

    It's so important to vet employees in that area and run background checks. To cover yourself i would hire professionals to do it like a temp agency.

    He probably meant 'proscribed' drugs?

    They will need "Gardai Clearance" which can take a number of weeks.

    My advise is get professional legal advice on what you can and can't ask and what needs to be checked for each applicant. There are any amount of solicitors who specialise in employment law and it will save you making any expensive mistakes.

    Agree with Fintan on that one. And yes, it does take weeks! :(

    As regards the drugs, I think its normally phrased "Have you ever been dependent on any substance that would prevent you from fulfilling this post" Obviously worded different to that.

    In relation to asking, I think you can ask anything. If you want to know, they have have the right not to tell you. However, they do not have the right to mislead or withhold information. You just can discriminate on certain grounds based on the answer e.g. Gender, Social background etc.
