    My tv broke again i have a philips 42" 7662d

    I went back to the shop and they said that i can have a new 42" 5604 or a 42" 7603 i dont know which would be better.

    I asked for a refund and i was told this is not possible because both tv they offered me are better than the one i returned.

    I have sky hd and use the Xbox 360 that all the tv is used for.

    Any info would be much appricated.

    That's no excuse for not giving a refund, if you really want one they've got to give you one unless you contributed to the TV being broken (which I doubt, because they most likely wouldn't offer you a different TV if your negligence was a contributory factor).

    Philips only have a 5404 32" listed, but I'm going to assume it's the same TV just a bigger screen on the 42" you've been offered.

    The 5404 seems to have an MPEG-4 Digital tuner, USB port with media support and Pixel Perfect HD.

    The 7603 has Ambilight, no MPEG-4 tuner, no USB port, and Pixel Perfect 2 HD.


    Neither of the TV's you've been offered are great IMO, it might be worth considering the refund, throwing another little cash on top of it and getting another TV like the 7404/8404

    Ive tried for the refund and i was told there is no way there giving me one.

    I told the manager that i would consider there offer but think that i might let it go to the small claims court.
    His reply was im more than welcome to do this but because there offering me a tv with a higher spec than my old one things would probably go there way.

    I told him that i would ring him tomorrow my decision.

    Taking them to court would be a lot of hassle and dont think it would be worth it.

    there is no way it can go in their way. Your consumer rights say you are allowed a full refund. They could offer you 10 times what you paid in goods if they wanted, you could still demand a refund. And its not even a small claims court thing, you shouldbe able to contact someone in the comsumer rights agency and they will tell you what to do.

    Ive already rang them and they said that i should look at what there offering and if im not happy the only thing i can do is take it to court and see what happens.
    Im not really interested in going down this road because of all the hassle.

    Steder, I'd look at the Consumer Issues forum (http://boards.ie/vbulletin/forumdisplay.php?f=580), there are many knowledgeable people on that forum and while it doesn't constitute legal advice, usually it's pretty solid.

    You've implied in your first post that you've allowed them to repair it once or replace it (via mentioning that it broke "again") - you're entitled to a refund. They could offer you a brand new Philips 9664, and while you're mad not to take it, it is still your call afaik.

    I would go with the refund, while what they are offering "costs more", I still don't think it's a great deal as you could probably get a TV better than the 3 tvs (one you own, two you're offered) if you got the money back and threw in a few bob on top of it.

    And just to go even further off topic (sorry mods), if they didn't comply I would let it go to the small claims court on a matter of principle. We Irish always back down because we don't want the hassle, and it lets retailers get away with some mad stuff like this.

    I think next time you should buy your TV from RicherSounds/Philips Shop here on boards, they know how to treat a customer with a legitimate issue :)

    The fact they told you all you can do is go to the claims court proves they know they are not meant to be doing this and they dont care, as they expect you to back down. They are in the wrong, not you.

    My girlfriend bought it for me as an xmas present for 2007.

    Il have a look at the other forum for some more info.

    IF i do get the refund RicherSounds will hearing from me very soon:)

    Apologies I just spotted this thread - I am presuming you did not buy the TV from The Philips Shop??

    If not please don't post here where you DID buy it from (that would not be fair to the other retailer as they have no right of reply here) HOWEVER - if you do reach a blank wall with the other retailer please just send me an email with all the details to johnmc@richersounds.ie and I will speak directly to Philips and see if there is anything they can sort you with - they are normally really fair when it comes to these types of issues.
