How long can a person legally work under a temp contract?

    Hi,

    Is there a limit on the period of time that a person can legally be employed under a temporary contract before the employer must make them full time or let them go?

    I have been working full time hours for nearly two years via a recruitment agency. It's a similar story for several people on my team in the company I work in.

    oooh i'd like to know about this too - 3 1/2years working in a contract position - Role is increasing a lot - pay isn't :(

    no is the short answer. temp contracts have a begining and an end or period or time with an option to renew or not.

    more than likely they are a contract with an agency not directly the company you are working for.

    Its known as Fixed Term Contracts- and is governed by the Protection of Employees (Fixed Term Work) Act of 2003.

    Essentially- if you've been on fixed term contract(s) for a period of 3 years- an employer may only renew your contract 1 further time, for a maximum period of 1 year. Once you exceed 4 years continuous service, or are on a contract subsequent to a one final contract post 3 years continuous service- you are considered to be on a contract of indefinite duration (aka you are a permanent employee). For the purposes of the act- if an employer lets you go and then re-employs you again- but less than 3 months has elapsed since the end of your previous contract- there is considered to have been no gap in your employ.
