Driving Ban

    Hi,

    The gardai recently came to my house with 9 summons for my brother. They are all driving offenses, one for no insurance, dangerous driving, no nct, two for no tax and four for bald tyres.

    My brother has recently gone to Australia, when I told the garda this the said they would just keep coming back and if he couldn't get in contact with my brother they would issue a warrant for his arrest so I took the summons.

    I'm not looking for any legal advice, I was just wondering what kind of punishment do you think he'll receive?

    At a guess I'd say a 1-2 year driving ban and a couple of thousand euro fine.

    Any other guestimations?

    Imprisonment is another possibility esp if he does not appear.

    He got a summons for each bald tyre? Pull the other leg. The usual is failure to be insured, failure to produce evidence of insurance on demand, failure to display NCT, failure to produce NCT. etc.

    Yes he got one for each tyre, all 9 summons will be heard on the one court date.

    Is imprisonment and a criminal record likely?

    Does he have to come back form Australia, can somebody just represent him in court? He'll be pleading guilty.

    He will need a solicitor. A criminal record is a certainty.

    Did they forget to check the spare in the boot? :D

    Is it??? I was always sure it would have to be handed to the person directly???
    Anyway, get a solicitor to rep him in his absence. Off the road for 2 years 1000euro fine be my guess provided no previous crimes... I wish him well....

    Leaving it with any adult at the last known address is good enough.
