what happens if the bank takes the house?

    Hi im not sure is this is the right place to ask but just for the moment i wonder if someone could help spread some light on the matter.My brother got a mortgage on a house about 2 years ago with his girl friend .So both his and her name is on the mortgage and the deeds. They also have a €20,000 loan with both their names on it. they split up over a year ago and she since then she has not paid a cent to the mortgage and she has stopped paying the money towards the loan. She is now on the dole and wont answer her phone or reply to the banks .She does not want to pay anything and so the brother has been doing all the running around and dealings with the bank.My brother was talking to her father and he said she would agree to take her name off of the deeds so at least then in years to come she would not have any legal claim on the house but she refused to sign the paperwork. She basically wants to be able to still have the house but just doesnt want to pay anything to it and have the brother pay for all of it.
    My question is if my brother now decides not to pay for the house at all or the other loan what will happen? I know there will be legal proceedings and the house will be reprocessed but what then? will he still be legally forced to pay for the mortgage even after the house is reprocessed? and for the other €20,000 loan? What if he still refuses to? i doubt there would be a prison sentence and can they legally force a direct debit after that for the money? does she get off free cause she is on the dole

    here's some financial advice though. You will not be able to take her name off the deeds without engaging the bank. Any move to absolve her isn't a good idea, given negative equity is almost certainly an issue.
