Drink driving charge.

    Recently i was charged with drink driving i fully co-operated with gardai and really didnt believe i was over the limit. turns out i was 5 micrograms over the limet for a blood test but when the doctor took the sample he forgot to seal my own personal sample i was half way home walking of course when the gardai pulled up next to me and told me they forgot to do something so i co-operated and went back to the station with them and the doctor sealed my sample...
    Surely this cant hold up in court due to the fact that my sample is compromised....... Any ideas anyone??????

    sounds as you have a valid arguement , your sample had been left unsealed for a period of time potentially allowing someone to tamper with it ........ throw that post up on politic.ie a lot of reaally smart people over there

    If you did the crime, then you really do need to pay up.

    Think of this: my brother was hit by a driver 3 weeks ago - leg broken in two places and the shoulder ball of the humerous broken off. As he can't use crutches (shoulder), he's in a wheelchair for 4-6 weeks.

    Now, whatever about lack of proper procedure, do you deserve to get away with this?

    The OP was looking for legal as opposed to moral advice. Whilst I feel sorry for Victor's brother and would wish him a speedy recovery, I fail to see the relevance in the instant case as this has absolutely nothing to do with the OP. In any event, OP you need to make an appointment with a solicitor as soon as possible to discuss these matters because a forum such is not a suitable or appropriate place to receive advice of this sort.
