I'm 17, and I was out drivin today, was around Marley today droppin a friend off, started revvin', eggin on the punters an all that jazz, when a garda pulled me over, took my (provisional) license, took down the reg number and whatever, told me there better not be anything wrong with the car, and said look forward to a court summons within two weeks.

My questions are, what could have been wrong with the car, and will the summons go through, or will it fall under the radar. I ask because I was driving without full license driver or L plates, but then he let me off home, surely this would be dereliction of duty?

    Thanks to anyone that replies.

You'll get a few summons in the post for driving unaccompanied, non display of L plates and several others that I can't think off. Why should the Guard have to spend the rest of the day dealing with you being a twat when it's all done by mail?

  • Registered Users, Registered Users 2 Posts: 9,727 ✭✭✭Midnight_EG

So would this summons go through, or should I throw it over my head and forget?

  • Registered Users, Registered Users 2 Posts: 19,106 ✭✭✭✭TestTransmission

It'll go through, what kind of car do you drive out of interest?

  • Registered Users, Registered Users 2 Posts: 9,727 ✭✭✭Midnight_EG

    A Honda Civic :L

  • Registered Users, Registered Users 2 Posts: 71,142 ✭✭✭✭L1011

If you get the summons, it'll go through. The Guard clearly didn't want to spend all day arguing with you over details.

It was literally only a minute, he tookmy licnese, took down whatever details and sent me on my way?

  • Registered Users, Registered Users 2 Posts: 19,101 ✭✭✭✭Del2005

Standard procedure now is to take details and send on the way, then send summons out when entered into Pulse. Just noticed your 17, all you'll get is a JLO call. Search the site for it.

So I'll basically get a curfew? Or just a threat of having a JLO? Not quite clear on it?

bollox that a 17 year old doesn't get the same punishments as 18 or 80 year olds when driving to be honest.

You were sitting there revving? What?

Unfortunately for you, as a 17 year old with a learner permit in a honda civic with no L plates (You really ticked all the boxes there) I'd say you can expect a day out in court and don't expect to get off lightly either.

Think it covers everything that goes through the courts system. Definitely can be used for motoring offences.

A JLO caution is what you'll get.....judging by your lack of understanding I take it you never got one before.

Its an official caution given to persons under 18 by a Garda in the presence of your parents. If you do not accept the caution you'll will be prosecuted. If you commit another offence would will likely be prosecuted.

On another note.....why would you do such a stupid thing....your drawing attention on yourself! Kepp the head down and stop acting like a child. In my opinion you stop being a child when you sit behing a wheel. How you dont take offence

Edit just say posts inbetween mine....arrested before.....enjoy the court system.

No L plates, unaccompanied, no licence......and whatever vehicle offences that were detected.

You couldn't have stood out more really.

    17, Civic & Male.

The Garda probably thought "easy pickings".

nice_guy_always, dont worry, no offence taken, I know it was a crappy thing to do an all, ruined a good day and whatever, but i really wanna forget about it you know. Woulda been fine if the girl didnt point me out like :[, but still, thick of me i know.

And yeah I've gotten away with the JLO caution before, as I said, 2-3 years ago.

You seem very smug with this .

do you have €1000 to pay your fine for driving by yourself on a provisional licience and most likely another fine for not having L plates

If he gets the JLO those fine won't come in to it. But it'd be 2 grand otherwise with the two fines.

You are only 17yrs old so you can be dealt with through the JLO for having no L-plates and no accompanied full licenced driver with you.

Also a Garda cannot take the car off you nor can a Garda stop you from driving away in your car so there is no dereliction of duty.

This is a great way to begin your driving career. Cop onto yourself and keep yourself out of trouble.

Not being funny....grow up when behind the wheel and understand your actions. I certainly have my fill of fatals this year alone (not all youths before anyone attacks the O/P)

Wait and see what happens. If a summons arrives contact the Garda, say sorry (if you are) and ask could you be cautioned as you havint been in trouble for 2-3 years. Best of luck

Could be around €1500 depending on the other offences in court

    I would bet no JLO

    I would say

1 . Fine for Driving Unaccompanied
2 . Fine for not displaying L plates
    3. Points on Driving licence

A JLO will have to sent to the JLO office for consideration. If the OP has previous JLOs as he has just said, these JLOs will also be taken into consideration too. If it is felt he is not benefiting from the JLO or if the crime is not suitable for JLO they can direct the Garda to prosecute him in court.

Any crime not considered suitable for JLO would be a crime of the higher end of the scale such as murder, rape, kidnapping etc, etc. However if the OP has several thefts under his belt the JLO office eventually direct the OP to be prosecuted.

This is all hypothical of course and is no indication the OP has committed these crimes.

If you want to bet money on that then I will take you on. NGA and myself are both Gardai with NGA in the Traffic Corps. Maybe thats an unfair advantage. :D

Also you cannot get points on your licence for driving with no l-plates and not being accompanied.

TBH the JLO office is fully. They could recommend up to 3 cautions before whats know as blanket approval is issued.

Every time a garda wants to prosecute a person under 18 he must recieve JLO permission. Every time.

    Points....for what???

Fine, fine, fine. All in court. Direct summons....no FCPS for these offences.

Seeing that I cant get points is a majoy relief, I dont want to get a license with 2 points stacked on already, I'm currently waiting for a date to do my test, so this is really fraying my nerves :[ although, every single person has been of the utmost help.thanks to everybody.

Yes you can which are transferred to your full licence when you get it. Also points are only applied when you pay the fine....not from the date of the offence.

Under 18s normally get a JLO though.....

Uhm, sound? Live in Saggart, have a passion for cars, in love with Hondas, spent my own money rather than 'robbing' it like a knacker would, and can I ask what brought on this insult? Was there a need for it?

OP - A bit of advice, throw up your L-plates and dont draw attention to yourself. Why would you give the guard a reason to pull you over?

It was a fairly stupid thing to do,

young males get a hard enough time as it is, no need to go proving that your right to get a hard time.

    Ok. Quick recap !

Young lad, Honda Civic, revving the engine to an audience.

    mmmmmm

    No L plates - offence
    No qualified driver - offence

You should be summonsed as you are typically the kind of person who can and will get into more trouble in the future.

These are based on comments, not my views.

  • Registered Users, Registered Users 2 Posts: 8,451 ✭✭✭CharlieCroker

NGA, would I be right in saying he could get a summons for driving without reasonable consideration too?

OP, its quite possible that this will end up being dealt with through the JLO but be prepared to go to court.
Get your car in order ASAP, cop yourself on and learn from it.

    yes, yes, yes

I hope I dont get into anymore trouble really :[, really thick thing to do, but damn I hope I get a caution, dont wanna ruin my driving career before it starts, I'd rather get stopped and asked about the car, how I got the money for the mod's etc, rather than stopped for noise or other stupid actions :/

I was stopped in traffic at the time, so would it still be inconsiderate or?

And nothing wrong with the car at all, so it should be fine should it be inspected.

  • Registered Users, Registered Users 2 Posts: 8,451 ✭✭✭CharlieCroker

Well, make sure the L-plates are up, make sure your number plates are legal, no big sunvisor blocking half the windscreen, stup stuff like that.

Nothing wrong with modifying your car if thats what you want, but don't draw attention to yourself.

  • Registered Users, Registered Users 2 Posts: 9,727 ✭✭✭Midnight_EG

Theres the thing, I'm looking to change the colour, maybe, the car is currently black (only adds to the cop-appeal), so I was thinking either VTI blue or S2000 yellow, would either attract police more or? Not really sure :L

  • Registered Users, Registered Users 2 Posts: 71,142 ✭✭✭✭L1011

Yellow and white would attract attention more than any others I'd suspect, even black.

I've a factory 'modified' car that seems to be relatively invisible to police, its anthracite grey.

However, respraying a car properly costs SERIOUS money; and the colour is only a small factor in how noticeable it is!

  • Registered Users, Registered Users 2 Posts: 9,727 ✭✭✭Midnight_EG

Yeah I was thinking about a form of grey aswell, sort of...falls into the crowd eh, by any chance is that a Silvia you drive? Or else an Audi of some sort?
