Case struck out because of delay, but delay was by defence

    Hi all,

    I am so curious as to how this is possible. Hopefully someone can enlighten me.

    I have just been informed that a case where I was called as a witness has now been struck out because of the delay in getting it to court.

    The thing is all the delays were caused by the defence side of things, they basically made themselves unavailable for all sorts of reasons.

    Meanwhile, all the witnesses that received a summons from the Gardai showed up every time and hung around for ages only to be told to go home.

    I'm not going to say what the actual charges were just in case.

    This is just amazing to me that this can happen!

    Can anyone shed any light on this at all?

    Well over a year!

    We were all receiving summons notices every few months, sometimes every few weeks, then we'd go to court only to be told the case had been adjourned because of any number of excuses given by the defendants legal team. Or we'd get a phone call or message the evening before to say not to turn up because of yet another delay, but the prior notice was if we were lucky!

    It's just amazing that it is so easy to get away with something so serious.

    Get charged with something serious? Don't worry about it, just get your legal team to make themselves indisposed again and again and eventually it'll get struck out......amazing.

    Oh I think it's best if we don't get into that conversation don't you?

    I'm just so curious to be honest. The local Garda that informed me of what happened was pretty amazed too. The fact that if the person in question ever comes to the attention of the Gardai for a "similar" offence that this offence will be brought up isn't really much help to me though.
