    Hello, I have just won a major agency for Ireland. If I set up a new type website with a specific mode or principal is it possible to protect the "idea" from copycat business' doing the same?

    can you be more specific by what you mean by a "major agency" - a franchise of some sort?

    it's very difficult to protect ideas online - low barriers to entry make it easy for anyone to come along and create a copycat version of your website if it is successful and theres very little you can do about it unless you have some form of global patent or IP protection - even then it's very hard and rare.

    From what you describe – the idea might be “out there” anyway, so the whole area of intellectual copyright really won’t help. I know it a bit of a cliché – but try to get there first and be the best at it – that’s the only protection.

    Question is do you know much about online business? Having a website means nothing if no visits it and it doesn't drive sales. There's a big trend at the moment for people starting web businesses as they seem like an easy option and have low start up costs. Its unfortunate that most of these wont be around in 12 months.

    On the other hand the web business is fantastic when you get it right, tonnes of fun and very scalable. PM me if you need any pointers.

    Best way to protect an online business is to grow so fast that your always one step ahead.

    Ok just to start again. Lets say I have won a healthcare agency for this major brand known throughout the world and now I have the "exclusive" rights in Ireland. I can sell this range and anyone who wants this product/products now has to go through me or be referred to me.

    Now upon winning the agency for Ireland I notice a website opportunity that I believe could skyrocket this brand in Ireland and potentially throughout the world. Although this company already has websites in many different languages and countries as expected, this idea I notice is not on it or on any other competitors websites. I know this new system or service will benefit my customers 100%! Here is my predicament and queries.

    1. If I roll this idea onto my Irish site and it is successful can I protect it?

    2. Can I license it out to the other websites throughout the world within this brand? ie..If the company decide yes lets do this on our 35 websites, can I agree, because it was my initial idea, I will take '3%' of future earnings from this site worldwide for example?

    You cant protect the website idea - So if your selling product X on your website other people can also sell the same product on a website they create.

    However as you are an exclusive distributor they shouldnt be able to source this product without purchasing it from you or one of your agents.

    If your idea is a certain piece of technology within your website then I think you can licence or trademark this idea - Amazon did this with their one click checkout process.
