Attacked in Dublin.

    I was recently attacked in Dublin City Centre last thursday night. I attempted to step in between a friend and his attackers and was assaulted by several youths brandishing Crutches. I took several blows to the Ribs and head and was rushed to hospital where I received 6 stitches.

    I was Taken to hospital at 1 am (ish exact time is a bit blury) I was not seen by a doctor till 8 am when I received the stitches. I was given no pain relief at all. I also received bruising to the ribs on my left hand side with the origional blow.

    My question is as I do not know my attackers and would be hard pressed to identify them again can I claim against the state? I have since been and made my official police statement and I am very cagey about going out in public in the evenings... I have also been suffering severe headaches since then,,, i am not familare with Irish law so any help would be great.

    I can't see on what grounds you can claim against the state.

    You were just very unlucky but also lucky in that you didnt get a worse hidin. Most times, in that position, you should just grab your mate and run very quickly!

    I really doubt you can claim against the state.That being said I really don't know.you say that you are scared of going out.I think that you should remember that this was a very rare and unfortunate thing to happen.I got beaten up in town myself one night but I realised that I just need to get on with my life as normal.At the moment you are probably suffering from post traumatic shock...I think if you go out and see that nothing bad is going to happen,you can slowly bring yourself to going out on a regular basis.

    I'm very sorry this happened to you, scumbags :mad:

    However (and i am not that familiar with the law either), what would your case be? :confused:

    It was individuals that attacked you and waiting 7 hours to be seen is less than average i am sorry to say, i have sat 14 hours waiting to be called. You could make a complaint but it would be once of many and not get you any satisfaction.

    You must be furious and feel someone should pay, but What did the state do or not do that makes you think you can make a case against them?

    I'm genuinely curious :confused:

    i heard a very similar story about a polish guy attacked and he is suing the government because there was'nt any garda around patrolling the area

    " in poland you'd never see this " was his case

    OP - can you get the Gardai to check if there are any CCTV cameras in the vicinity of the assault. A lot of the city centre is covered these days and if the guys had crutches then it would be even easier to pick them out.

    As for suing the state - not a hope as they're not responsible.

    There is a criminal compensation fund that awards people money who are the victims of crime and receive injuries. Not sure on the details.

    Also if you are a victim of crime the Garda attending has to by law give you his card and tell you about a support person you can contact for any stress issue relating to the crime.

    TBH you sound like you just want some compo, but the Garda made a mistake if they didn't do the above, so fair is fair you could probably sue them.
