    Howya folks.. Apprentice bricky ere thats wanting to go travelling to both canada and australia. I had a clean sheet for travelling until the other night I got caught with half a quater of hash by the garda. What can I do to get around this so I can go travelling is there anyway around out it. Like for christ sake its a small bit of hash?? I wouldn't mind but im not even a heavy smoker! Help!

    I don't know how wise "oh the Humanity"'s advise is. (No offense m8 :)).

    If you do a runner and dodge a summons this could have legal implications further down the line and you could end up in hotter water than you were originally.

    I would suggest getting the advise of a seasoned solicitor who knows how these sort of things pan out. Their predictions for what a judge will do / sentences can be remarkably accurate and its certianly for the best.

    You don't get a record for such a small amount, just a note on your acc.
    3 strikes system AFAIK.
    Unless it's more than an ounce, it's considered for personal use.

    They can still do him for possession.

    But if they dont serve him with the summons then he doesn't have to go to court and most likely it will get thrown out.

    Not true, I was done for less and was on probation for two years including a €250 euro fine, another guy I knew was convicted for a quarter and had to appeal it.

    The guards generally are not that efficient though. Sure even their supposed database is a shambles.

    If the guard goes up to the address he gave and cant serve the summons because he is not there, that will likely be the end of it.

    Yes, there is the miniscule risk that you will be unlucky and the Guard in question is miffed you scarpered and decides to try to somehow record the fact somewhere....where though?

    Like its hardly a case they will alert the feckin airports over it. He is going off for a while and is likely to be able to re-enter without a problem.

    I dont think they have a system for unservable summonses. Sure even half the stuff that does make it to court is thrown out. As far as I can see 90% of small cases like this the person doesn't even turn up and the Judge dismisses it rather than waste more court time.

    As I say though, if you have loads of cash, yes get a barrister. But if not its a risk worth taking.

    Wow.

    OK, well in my personal experience, and that of many of my friends has been that with a small amount it was confiscated and nothing more was heard about it.

    Did you have any previous convictions or anything? That sounds very heavy handed for a first offence.

    If you do get summonsed, then it depends entirely on the judge.

    It can happen that, when a judge hears that the accused intends to travel to the US, the probationary act is invoked as long as the accused makes a donation to charity.
