Littering ticket based on my car reg!!!!!

    hey all,

    i was in dingle for a stag 2 weeks ago and afterwards we deposited our empty bottles in the bottle-bank in dingle town. i have just received a ticket for €150 for littering based on my car reg!!! I can only presume the cardboard boxes the bottles of beer came in constituted littering and they got my details through my reg when i pulled up to let my passengers out with the 2 boxes of empty bottles.

    can i dispute this, since i didn't personally do it?

    also, what happens if i ignore it? bench warrant and the next time i get stopped at a check-point (tax etc) i get arrested?

    If you ignore it you will be summonsed to court and fined in your absence. Fail to pay the fine and you will have a few days in Mountjoy to contend with.

    fair enough, but how in the name of fairness can i be fined for the alleged littering my passengers did? why has no one contacted me for their details? if it was a speeding offense i would at LEAST have the option of putting someone else's name on the ticket (on the basis that it was someone else that had committed the offense)

    The legislation allows them to prosecute the registered owner and makes the assumption the the owner was the culprit.

    is there anyway of fighting this on the basis that i personally did not litter? OR is the solution i appeal to the conscious of some stag hounds? and get them to split the bill (even though i had NOTHING to do with it)

    BTW, this is VERY unfair legislation. and i am AMAZED there is no way to fight it (on the basis i didn't litter)

    Yes Romperstomper as another poster has pointed out you are liable for litter from your car under Section 27 of the Act. ( 1997 ). Also look at the presumption in Section 26. If the summons has issued contact a local solicitor. Judges do not like litter and the fines can go to €3000 plus costs and council's expenses

    hey guys, there is no contact number or anything on the ticket. can i pay this in the garda fixed fines office on o'connell st in dublin? or do i have to ring round kerry offices to find an address to send a check? thanks

    Go to the local cop shop.
    If you ignore it, it will cost you in the long haul.
    I seen an example of this before.....
