Man gets 45 years in prison for spreading HIV

    McKINNEY, Texas - A jury sentenced a suburban Dallas man to 45 years in prison Friday for knowingly infecting six women with the AIDS virus.

    Philippe Padieu, described by his own lawyer as a "modern-day Casanova," shook his head and looked down when the decision was read. Jurors sentenced him to 45 years on five counts and 25 years on the sixth, to be served concurrently. Padieu had faced up to 99 years.

    The Collin County jury convicted 53-year-old Padieu (pah-DOO') on Wednesday on six counts of aggravated assault with a deadly weapon. Since HIV is the virus that causes AIDS, prosecutors contended Padieu's bodily fluids were a deadly weapon.

    Padieu is a former martial arts instructor who continued to have unprotected sex after he tested positive for HIV in 2005.

    Assistant District Attorney Lisa King in Collin County told jurors earlier Friday that Padieu deserved a life sentence.

    But defense attorney Bennie House said Padieu may have made mistakes as a "modern-day Casanova," but did not intentionally spread the virus. He said a 20-year sentence would be fair.

    Jurors heard testimony was Thursday in the punishment phase, including from women who described the harm that the HIV diagnosis had done them.

    Padieu himself also took the stand, saying he was a victim of overzealous prosecutors. He said the women who accused him had all had multiple partners.

    I like the last line.
    Really puts it all in perspective.

    Depending on how long he had the virus before he was diagnosed, he could be still around in 20 years - maybe much longer again if drug therapy improves as it has in the last 20 years.

    Well if he stays in without parole he'll be 98 before he's released. Even completely healthy people don't usually live to this age.

    No I'm saying that it's unlikely he'll ever leave prison.
    Advancements in treatment of HIV can fend of aids for much longer now but not that long.

    why didnt he create reasonable doubt .... all he had to do was find another previous partner of one of the girls who had HIV and theres reasonable doubt as to who actually infected her .... and reasonable doubt that the other women had unprotected sex with other men - increasing their risk of getting HIV.

    Did the report say that he continued to have unprotected sex
    AFTER he tested positive in 2005? This is what I read. So, he did
    know he had it and he did spread the disease knowingly

    This opens up all sorts of issues, what if a person thinks he/she MIGHT have an sti and then has sex? What about pregnant women who pass heroin/cocaine to their babies - surely that's a crime too?

    I think that there is generally a presumption that if someone is willing to have unprotected sex with you, then they aren't going to give you a fatal illness.

    I'm not talking about complicated social mores ... I'm talking about this guy's sex partners; they have an obligation to themselves, they should have insisted on him wearing a condom.

    Being willing to have unprotected sex with someone isn't the same as having that person's best interests at heart.

    Boy meets girl, boy says to girl "hey, I would really like to have unprotected sex with you ... don't worry about anything, the fact that I'm willing to have unprotected sex with you means I probably don't have AIDS, HPV, Hep B, Hep C, herpes, gonorrhea, syphillis, chlamydia or crabs. Whaddya say ?"

    The data sort of contradicts that... both the median age of seroconversion and the median age of death have increased in line with each other over the past few decades, i.e. people are still only living for a median of 10 years - the same at they did in the 80's and 90's.

    But that's a different topic for a different forum. :)

    That is a good point, it is not like he slit their throats. If a girl "knowingly infected with a cold" kisses a lad does she get a few months in prison. What about people "assaulted" by passive smoke by people knowingly having a deadly weapon which lead to cancer which could eventually kill over a long time.
