Can we get married cut off

    Married couple living in Ireland. Spouse works in Northern Ireland under Paye Employment.
    I have started PAYE employment in Republic. Can i get the increase in standard cut off from 36,400 to 45,400?

    Your partner will be taxed as a single person in NI and he/you will have to submit a tax return at the end of the year.

    You could well be both treated as single people because of the cross border relief, but I'm not certain. Best thing really is ring Revenue.

    It depends on the interaction of cross border relief with the married credits and the standard rate cut off.

    As cross border relief acts to exempt the foreign salary from the charge to Irish tax it may mean that you are assessed as a single income married person, may need to be assessed separately or indeed in theory the foreign tax falls to Irish tax at first instance and then is exempted by cross border relief. It's a bit technical. I'm not in work so I don't have the legislation to hand to look it up and off the top of my head I don't know. I don't recall reading a tax briefing on it.

    If someone out there is curious and has the legislation to hand you may get an answer, Otherwise, ring the Revenue and see if they can give you any guidance.

    You say that your spouse works in Northern Ireland under PAYE employment - Is the company registered in the Republic?
    Cross border relief works on total income and income that is been taxed through Inland Revenue (English revenue). Basically, if your spouse is earning and paying tax to Inland Revenue and you wish to be joint assessed, you make your return to Revenue stating your spouses total income and that you wish to claim cross border relief. This is so your spouse is not taxed twice. You are basically stating that his income has already been taxed by Inland revenue. If a portion of your spouses income is earned in N. Ireland then you claim cross border relief on that portion that was earned.

    It does get more technical than the above so best advise is to contact Revenue. The above is just a synopsis! :):)

    .... to answer your question, yes on the above you can transfer ratebands and credits.
