Advice on what route to take

    I am currently experiencing a serious problem with my bank sending private account details to another person, and I am hoping you can give me some advice on what action I can/should take. Firstly, let me outline the problem.

    I have held the account in question with my local branch for ten years now, and during that time have always held it at the same address. In 2007 I opened a separate joint account with my ex-partner, the father of my son. We have since then separated and closed the joint account in late 2008. The problem is that for some unknown reason the statements of my private bank account are being sent addressed to him at his workplace, I first noticed this in December 2008, as most of my banking is done online, but I don't know exactly how long this has been happening, and my bank can't/won't tell me. This is causing me untold embarrassment and discomfort, as you can imagine, he is the last person I want holding my private financial information, especially as it is affecting the ongoing maintenance discussions.

    I have made the bank aware of this on multiple occasions by telephone, and have also written to them twice at their request. They insist that any change to account must be made in writing, despite the fact that there was never any instruction, written or oral, to change the details in the first place. Due to working hour constraints I have not yet had time to visit the branch, but plan to do so this week.

    I am disappointed that they could have made such a fundamental error, however I am more angered by the fact that they refuse to admit responsibility and have yet to offer and apology or acceptable resolution.

    NB: I am not seeking specific legal advice, but more along the line of who I should contact. I can't afford to pay for legal advice, so possibly a no win no fee solicitor? I've had a quick look at the financial ombudsmans site, but the complaint form wants a case number?

    I'm not sure if I've ever written to the bank telling them of a new address.

    First, write to the bank, saying change my address to XYZ on account 12345678, sorting code 98765432. Post or hand deliver the letter. Even consider sending it by registered post. Ask for an acknowledgement.

    Separately, write to them asking why the address was changed originally and on whose authorisation (account holder and bank official) and a copy of the written authorisation to change the address. Ask for a case number.

    Tell them that if you don't receive a prompt, honest and thorough answer, that you will be escalating the matter.

    Then financial ombudsmans, data protection commissioner and / or solicitor.
