    Hi my brother works for a large company in dublin and is the throws of an argument at work.

    I have a query that I would like your opinions on please.

    Text messages were sent between my brother and his colleauge on their private mobile phones (not work phones). One phone was lent to another colleauge who went into the text message inbox and sent items and read two messages. Both messages had negative things written about the third party. Who is more in the wrong? The two people who text each other about the other colleauge saying whatever they said, or him for reading someones private messages (he said it was by mistake, although how that mistake can happen multiple times is a bit strange).

    Nothing has happened with it yet but hes very confused as to what to do.

    As the messages were not in the public forum and werent sent using work related tech i take it that nothing can be used against him if HR are involved.

    Has anyone know of or even been in a similar situation, my bros just started the Job 3 months and understandably is a little nervous about the whole thing.

    Why did he lend his private phone to a colleague he doesn't like?

    Anyway, I don't think he can get into HR trouble for messages sent on his private phone. He should be very aware that he treats the person respectfully in work though, or he and his friend could be in trouble for bullying.

    Thanks for the advice. He dosent not like the guy it was really a private venting session that got seen. The guys Phone was dead and he needed to send a text.....i know iv already given him slack for being an idiot. The bullying thing is a valid point though thanks.
