    I know that the Supreme Court has heard the appeal but does anyone know if they have come out with a judgment yet? Evidence exam on monday so it would be useful to know if the entire law on unconstitutionally obtained evidence has changed!:rolleyes:

    No judgment. Last I heard was that the SC required written submissions from the DPP on O'Brien and some other subsequent case, memory fades as to which one. (Could it have been Dillon? EDIT: It's definitely not Dillon - That's the vagrancy case. Still can't rem the case they asked for submissions on!)

    So as it stands the law remains as was, taking in consideration Charleton J's finding's in DPP (Walsh) v Cash.

    do you guys think they are likely to affirm Charleton J's view or restate O'Brien/Kenny approach? If its the latter, i dont think the rule will ever be challenged again.

    Guys, any word on the SC judgment? Still cant seem to find it on either bailii or courts.ie.
    Think it may be relevant for the Constitutional FE1 exam.
