    Hey guys, first time here so i apologies for any errors in what I am asking about but here it goes.

    On the 28th of April I was sent many different e-mails from customers of ICE Broadband saying that they received the following e-mail and that my e-mail address as well as many many more which were on their open list. I of course am furious about this breach in privacy and have been spammed about 30 times in the last 2 days alone on my private mail address. I havent been a customer for over a year yet they seem to be keeping data on me. My question is, what are my rights on this? Surely companies cant just e-mail a list of their customers to random people leaving the e-mails open? Im really furious about it and considering legal action. I have sent Ice an e-mail with no reply as of yet.

    Our records show that your account is in arrears with us. Unless contact is made within the next 24 hours from the time of this email sent, to discuss clearing arrears we will have no option but to cancel our service with you, this may result in passing your account to our legal department which is likely to result in subsequent action in court or other debt collection proceedings.



    Arrears can be paid by cheque or postal order, credit card or direct debit. To pay by credit card, direct debit or if you have any queries in relation to this letter, please phone 1890 444 111.



    In the unfortunate event that we have to cancel service to you due to non payment of these arrears or you have not contacted this office with an explanation for non payment then under clause 7 and 8 of our service agreement with you we will shortly be on site to retrieve our equipment.

    ok kinda confused as to what happened.

    am i right in thinking you got a bunch of emails from a number of different people and those people were replying to an email from ICE

    OR you recieven and email and could see teh email addresses of a number of ICE customers?

    or an ICE mailing list was leaked and you are on that mailing list along with others

    was there any links in that mail you recieved? cos that looks like some form of phishing expididtion to me to be honest. have you tried Phoning ICe to discuss teh matter?

    in relation to your privacy, IIRC teh data protection commissioner considers email addresses and IP addresses as personally identifiable information. Alos a data controller must

    These provisions are binding on every data controller. Any failure to observe them would be a breach of the Act.

    now here's the thing, I did my thesis on data protection and the data protection commissioner has no direct powers to fine a company for a breach, they must issue legal proceedings through the courts. to date they have never done that (that's what they told me anyway) and prefere the loss of reputation and possible loss of revenue that comes from loss of customers.

    I was apparently on a leaked mail list to hundreds of ICE customers, some of these customers then e-mailed me (as well as the other leaked addresses) saying they received an e-mail from ICE and could see my address in this e-mail. I have also received a huge amount of spam e-mails in the last 2 days which I am really annoyed about ie. "How to make your penis bigger" etc...

    .....Don't bother with the making your Penis bigger it doesn't work , all you get in the post is an elastic band and some lollypopsticks.

    Seriously though thats awful.They are pretty nasty about it also, threatening to come to your premises to retrieve their equipment.

    My opinions.
    1. Is it true, are the facts in the email true.
    2. I have read some law journal where a incorrect bank statement could be defamatory. I would email all the other people and get together and sue ICE in a class lawsuit. You will win if you all get together.
    3.If they did this deliberately "to shame you " then its defamatory.
