    Got me thinking.

    I'm a a cyclist (communter and for training) and always assume I'm subject to the same rules of the road as other road user's.

    The OP of that thread states he rode his bike after four pints of beer, so legally what are the consequencies should he be stopped by a Guard?.

    you can be sumonsed to court for drunk in charge of a pedal cycle...

    but i cant remember the maximum penalty for it

    Dirty dog! Speak for yourself! But yeah, i was in court in Galway when the judge heard the evidence for this complaint for the first time! She was unsure of it herself!

    Ahh Good old 51(1) of the RTA. Sure beats the standard Section 4 POA which a lot of members seem to resort to.

    I don't know about the legalities, but i'd make you sleep with your hands over the blankets and think about what you've done.

    We've all woken up beside the odd chopper in our day.

    From that link:
    A person shall not, in a public place ... drive or attempt to drive a pedal cycle, ... while he is under the influence of intoxicating liquor or a drug to such an extent as to be incapable of having proper control of the vehicle or cycle.

    How is incapability measured ? Discretion of the guard or by using the breathalyser?

    It's down to the Garda at the time, but it would be just like forming your opinion for a drunk driver. Or I could be completely wrong. (Needs a more experienced member to confirm!)

    The member needs to form his opinion. It's basically simplicitor. There's no need for testing.
