Car and Ex Problem

A year ago my then girlfriend and i both traded in our 2 cars. Well i wanted to get rid of mine but didnt want the hassle of selling private so i asked the garage to sell mine for me. Now she could not afford the 1 she wanted. So the deal was that when my car sold i would make up the difference. Now we are finished and my car still hasnt sold, but she says she is not going to pay. Its in her name and i did not sign anything with the garage. Where do i stand if mine ever sells. I spoke to the garage and they dont want to get in the middle. I still have my vehicle of ownership forms.

So, your car is not sold but still in your name I take it, so who has the keys?. Did you sign anything with the garage in relation to your car being part of the deal and has your ex taken possesion of the new car she wanted?.
If you still have the Vehicle Registration Forms in your name & possesion, well it's still your car!. She bought the car off the garage and still owes them x amount that was supposed to be the sale of your car, which hasn't happened. So, can you not just take your car back if you haven't signed anything and get the garage to chase her for the balance owed on the new car she now has?.
I had a similar situation with an ex that got pretty nasty and I had to get the gards involved aswell. I was okay as the car was registered to me. He wanted to keep something that was in my name, loan in my name but because we lived together and shared the car while in a relationship, it caused terrible trouble for me.

Hey thanks for getting back to me Cath09 Yes my car still has not sold and still in my name, the garage have the keys for test drives. I did not sign anything with the garage. She has the car she wanted and says she will not pay, although the car is in her name.

Hi there, well listen that just sounds like she is being totally unreasonable and irresponsible. She is basically driving around in a car she has not paid for in full and the only reason she still has it is because the garage have your car.
I think you need to seek legal advice on your rights as regards getting your own car back, as it's still in your name, the new car is not yours and in her name. She has to pay for it and is getting away with it as long as your car is still in the garage, then you are left with nothing.
I hope it all works out for you, but make a call to a solicitor today, have your facts right, make sure your car is still in your name and you are certain that you signed nothing with the garage or with her, and try and get your car back!. Would love to see her face when the garage contact her for the cash she will owe them then!!.:D.
