Untaxed Car Issue

    A relative of mine recently received a fine in the post for non payment of car tax. The tax office had previously been informed that the car was off the road (not in use), and it was therefore assumed there would be no further issue. The car was parked on the road in front of our property and it was there that it was seen without an up to date tax disc, and the fine was sent out by the gardai.

    The gardai were then contacted to let them know that the car was not in use and that the tax office had been advised of this. A response to this contact from the gardai stated that they would look into the matter further, but in the mean time the fine should be paid before the date payment was required by.

    The fine was therefore paid, in the hope that the money paid would be returned after the gardai had investigated further. However, shortly after the fine was paid, another letter was received from the gardai stating that as the fine had been paid, they would not be looking into the issue any further.

    if anyone has encountered anything similar or just has on an opinion on the situation, i'd greatly appreciate it

    Even if the car isn't in use, once it's on the public road it needs to be taxed.

    If you wished to challenge the fine you should have not paid it.

    The vehicle needs to be in off-road storage to be not in use or "off the road" for tax purposes. By storing it in a public place you expose yourself to the tax requirement.

    'off the road' means not in use on a public road and in your case it was parked on a public road.

    I hope the insurance is up to date. :eek:

    The offence of no road tax, is park, use or keep the vehicle in a public place, covers both registered owner and user depending on the circumstances.
