    Hi

    I person i know posted some previously unseen photographs on facebook which i believe may be of some value to newspapers!

    What is the legal stance if i sell these photos to a newspaper?

    Facebook own all photos posted on their site. Taken from their ts and cs here:
    Proprietary Rights in Site Content; Limited License

    All content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of the Company, its users or its licensors with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the Company's prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site

    I don't think you can sell the photos on unless they are your own photos.

    It's not yours to sell. Except legal troubles if you proceed.

    What kind of charge would it be?

    Some type of theft?
    Also these photos are posted on a social networking website. Do papers not use these all the time anyway?

    Are the newspapers not stealing when they use the photos from facebook and bebo?

    Facebook would probably injunct whoever you sell the photos to from publishing them. You might find them hard to sell as most papers etc won't buy them as they are no use for them to use. You will find yourself in court most probably. In order to take the pics off facebook you have to tick a box saying you have the right to use them. You don't unless they are your pictures.

    Legal issues aside, shoddy 640 pixel facebook images won't be any use to a print publication.
