Garda Incident Reports

    When a Garda incident report is filed in respect of a road traffic collision do both parties to the collision automatically get a copy of the report?

    Someone backed into a friend of mine causing a few hundred worth of damage. Initially said they would pay cash but then said they wanted it through the insurance and now are dragging heels on making contact with their insurance.

    Next step is presumably to make contact with the insurer directly which I think requires an incident report to be filed. Curious as to the question above because if the guy suddenly decides to be cooperative it woule be handier if letters weren't being sent left right and centre by a Garda station.

    Thoughts? Not looking for legal advice to be honest, just really the workings of Pulse!

    My view is that Pulse is a terrible system and is as good as the person putting the data into it ;) If you catch my drift.

    Practically, you can resolve this by contacting the insurance companies in question directly. The Gardai are generally quite helpful with these things.

    Gardaí do not investigate non injury accidents. If they were called to the scene they would only have taken driver/passenger details. There is no report.
    There is however a Garda abstract report which only includes the details i pursume were swaped at the side of the road in accordance with law. A member will in no way give an opinion as to who is wrong.

    There is no need for the other driver to inform his insurance company. Your friend should have already contacted his/her insurance already and if they havint contact them straight away and they will start the process. The injuried party as such should not be put out to follow up on this, thats what the insurance company is for.

    Cheers for that, they asked me what to do and despite studying law I wouldn't have a notion about this sort of thing!

    So she should ring her own insurer even though she is the injured party or she should make contact with his insurer?

    The reason I queried incident reports is she rang the Gardaí when he started messing around and they said to file an incident report prior to her making contact with the other party's insurer. They also recommended phoning him again before doing so but that has been fairly unsuccessful.

    Contact her own company and explain the situation. They will take over and it should be stress free for her. Her insurance will look after it and contact his company. They will also request the abstract report if it is needed.:)
