Traveling to USA will I have problem if I have a drink driving offence?

    I'm traveling to US and I'm filling out the the ESTA visa form to gain access and one of the questions asks do you have a criminal record. I'm not sure if I should tick yes. I was convicted of a drink driving offence and got my licence taken off me so do I tick yes? will this stop me for gaining access? I'm only traveling for a few days with work? Any help appreciated?


    "B) Have you ever been arrested or convicted for an offense or crime involving moral turpitude or a violation related to a controlled substance; or have been arrested or convicted for two or more offenses for which the aggregate sentence to confinement was five years or more; or have been a controlled substance trafficker; or are you seeking entry to engage in criminal or immoral activities?"

    Firstly...Welcome to Boards.ie :)

    Secondly...any help we can give will mostly just be our informed decisions rather than actual legal advise.


    You can break this down into 3 different sections :
    >Have you ever been arrested or convicted for an offence or crime involving moral turpitude or a violation related to a controlled substance;

    Alcohol isn't a 'controlled substance'. And you probably won't have a problem as your offence isn't counted as 'moral turpitude'.
    Wiki has a list of what crimes (taken from the United States Department of State website) that will and won't count against you and says that :

    # Drunk or reckless driving
    # Driving while license suspended or revoked
    # Drunkenness

    are all examples of crimes not involving moral turpitude


    Moral Turpitude refers mostly to 'moral' crimes and in this case drugs = bad while drink = good (even if you lose your license).

    OK


    So I think you won't have any problems but there again, that's just my opinion. :)

    Thanks for the information it clears up a few items....I just don't want to fill out the form and have issues. The wiki linked helped a lot :)

    Drink driving is not a criminal offense, won't be a problem.

    Just watch out for all the "Were you a Nazi between 1939-1945?" type questions. ;)
