Legal Costs Relating to Self Build

    Hi Guys!

    Just in the process of putting together a list of "anticipated" extras for our build and I would like to know how much we should allow for legal/solicitor costs for the process? Also, what work should be getting our solicitor to do in the project?

    There should be no need for a solicitor at all . Hire a construction professional to obtain tenders , assign the building contract , administer that contract i.e. regular site visits / authorise payments / snag and certify at completion

    Hire an architect or architectural technician

    The Bank will require a Solicitor to sign off on the last set of document (i.e. compliance etc.) Some banks also expect the Solicitor to requisition the stage payments. Ring around for prices, as they will certainly vary.

    only if the build is to be sold on - and they will look for architects opinions on compliance
    Some banks also expect the Solicitor to requisition the stage payments. Ring around for prices, as they will certainly vary.

    not when properly registered construction professionals are appointed they don't . with all respect to our legal friends- I have not met one who would claim to be able to value works in progress

    The draw down of the final stage payment from all banks require a certificate of compliance.

    We will have to differ on that one. I believe there was a change in the Law Societies guidelines last year. The Solicitor now has to confirm to the bank that all the documentation is correct and in place before the final cheque is issued to the client. I don't think this has anything to do with whether or not the construction professionals are properly registered. It's another line of bureaucracy. Maybe different in different parts of the Country??

    in relation to solicitors,i rang 13 of the devils in a town in galway and they varied from 1800 down to 700euro...couldnt believe the difference..

    for my draws I need to apply to bank, they apply to "dublin" dublin send application to my solisitor to sign, they return it to "dublin" and then the jackeens send it to my bank for me to collect and spend!!

    lots of red tape. and difficult to manage cash flow when not going traditional contractor route.

    the bank require that a qualified registered engineer sign off the various stage payments and approve the build when completed. in addition to this they require that we engage the services the services of a solicitor - i imagine to deal with the contract between us and the bank, arrange the transfer of deeds to the bank etc....

    this is next on the list!!
