didnt get job that was promised

    hi, mr mel got demoted (him and his whole department - thats another story), anyway got told that he would get the job he wanted in a different department when the vacancies came about, so he was happy enough with that. he got a letter in writing to say the same effect, no terms and conditions etc. then he gets told he will have to take an aptitude test, interview etc etc, and doesnt get any preferential treatment from the probably couple of hundred people applying for the job. turns out he failed the aptitude test by about 20 points. most of his friends got the new job and have now moved to the new department and mr mel is totally miserable.
    im thinking all these 'promises' of the job he wanted were just to keep him/them sweet because of the de-motion etc.
    anyway do you think its worth persuing for him to see if he has any legal grounds on being promised the job? this would be a good job, the company would be a company that USUALLY plays by the rules, all through unions etc etc.
    anyone any recommendations on solicitors who might just dish a bit of advice and tell us yet or no??

    He failed the aptitude test. I think that alone would give the company the leeway to explain not giving him the promotion...

    I'm not sure if he'll get anywhere with this one. If all his friends when through the same process then I'd suggest that once they passed the aptitude tests they were given preference at interview due to their experience in their old role. It sounds like the company had to play by their internal recruitment rules and he didn't give them the opportunity to offer him the job because he failed.

    I'd suggest that his best course of action would be to talk to the people he dealt with about the opportunity originally. Let them know that he is disappointed that after the reassurances he had received that he's left stuck in his demoted position as he had one set of below par tests by his standards. Try to find out if there will be any other vacancies and get them to commit to putting him forward again. Make sure to be positive!

    I know we don't have anywhere close to enough information to make a good call on this but from what's available he sounds like he thought that he'd walk into the position ahead of a load of other people and is feeling sorry for himself...

    thanks. realise it prob sounds like sour grapes, but really they got screwed in the first place and this was the only 'good' thing that was going to come out of it. the issue of being demoted and all the other stuff is going to the labour court anyway, but god its such a slow process.
