ESB Deposit

    Im not exactly sure if this is the correct forum to post this question or not but I was hoping someone could point me in the right direction.
    I have just moved out of shared accomodation with my friends and moved home. We had split the bills up between us. I was in charge of NTL and rent, another girl put the gas in her name and my other friend put the esb in her name.
    Anyways the friend with the esb has rang up the esb for our deposit back and they say they dont have to give it to us because a bill was not paid in time( however we have always fully paid our bills)
    My query is, is it legal to refuse to give a deposit back even though the account is not in arrears and she did not sign anything agreeing to the deposit not being given back if late. Also she was never told over the phone either.

    Im probably reaking rules asking for advice and apologise. Even if someone can just tell me that ESB are legal or illegal in their actions

    The lawfulness of their actions is critically dependent on the service contract between your friend and the ESB. In the absence of the complete service agreement nobody could provide you with any legitimate advice.

    Beyond which, you are asking for legal advice so I imagine the mods will be along shortly to lock this thread.

    I always find the best thing to do when annoyed with an organisation like the ESB is shout down the phone at them.
