The most surprising thing about this article is that she passed her test 1 week after failing. Can you imagine getting a 2nd test so quick down here.
Anyone who wishes to contest the outcome of their test should be aware that even if a judge rules in their favour, the most they'll get is a free test. A judge cannot overturn a tester's decision.

I dont know the full details of this nor indeed the road layout or markings but from reading that article it would appear that she was in the incorrect lane. She should not have assumed that she was going back to the test center unless told by the examiner and therefore should have stayed in the left lane. What I find unusual is assuming she changed lanes safely and correectly I'm surprised that that fault in itself would cause her to fail the test - in my experience that type of mistake would not be a grade 3 fault here!

Good advertising for the instructor though :D

does that mean that her initial test results are null and void ...... so she passed (ahem) first time. !!

its crazy the things people will goto court over .... its not like it made much of a difference in her life (especially as she re-sat and passed the test the following week).

Sounds like someone in the family has a law background and was advising her to take the case :P

No , she just got a refund of the first test.

If it's the same as down here a Judge can not change the result of the test
