Bank Holidays

    Just got a call from a guy I used to work with. Since he came back after Christmas he has been on a three day week, working Wed, Thurs, Friday. When he asked about his entitlements to bank holidays (which all fall on days he wont be working) he was told by the employer that they are not entitled to pay him for it and that he has to claim it from the welfare, which will give him about a third of his days wages. However other staff who are working Mon,Tues Wednesday will be entitled to a day off for which they will be paid in full by the company.

    Have the company any right to do this or are they just bullsh*tting him in the hope they don't have to pay him?

    He has the right to be paid on a bank holiday even if he don't work it.

    He is only entitled to 3/5 (60%) of a day for a bank holiday if he isn't working that day.

    According to the organisation of working time act your friend is entitled to the following....





    Part-time employees

    If you have worked for your employer at least 40 hours in the 5 weeks before the public holiday and you are due to work on a public holiday you are entitled to that day off as paid leave or one of the alternatives as listed above. If you are not required to work on that particular day you should receive one-fifth of your weekly pay instead of the actual day's leave. Even if you may never be rostered to work on a public holiday you are entitled to one-fifth of your weekly pay as compensation for the public holiday.
