Ok so have just moved into a council house and it is a quiet street except for the house next door to me. they have serious scum in and out of the house at all hours over the weekend, major rows in it too (my eldest child woke up terrified i was a little bit too there was threats of retalliation with guns) have been told not to leave back door open for anything as they have a pile of rubbish in the yard and a problem with rats. Called the council yesterday morning and they told me they know all about them they are trying to evict but they contacted lawyers who are fighting their eviction notice on the grounds its in breach of their basic human rights to evict them.
From what i could make out this has been going on for almost a year the house im in now has been vacant for most of that time. I was told nothing really can be done till they go back to court with them again but they keep getting it adjourned and have been warned they can lodge an appeal straight away if the judge upholds the eviction.
Was also asked to make a statement to the guards about the threats i heard the other night but if i do i could be called as a witness in court dont really want to go there as it would basically mean never leaving the house on my own again.
Is there anything i can do? I cant understand why they gave me the house knowing well about the problems next door and i have 2 small kids.
any advice given would be really appreciated.

What about YOUR human rights!? If I was you, I would involve the police and local politician.

I have known people to be evicted from council property purely for noise pollution.

Keep at it, call them every day until something is done.

Be careful you are not targeted for contacting council

    op here again
oh they know now thanks to the council, called to make an appointment to go down to them and they came up to the house instead after telling me what time to call down! the neighbours left nearly as soon as he arrived at the house so much for being anonymous. my patner and i are taking it in turns to go out of the house in case they do something.

    to the op,

Get a list of all the local counsellors and TDs in your area, write a letter, an honest account of your fears for your children, explaining that you were placed in a house that people were previously moved from because they felt threatened. Forward this letter to the council. Go to your doctor and explain how anxious and nervous you have become and a sympathetic doctor may support you. If they do not reply, document everything and continue to write letters.

People should not be placed in houses when they are next door to people who are causing trouble. There must have been someone there before you and they may have been harassed out of the area.

I wouldnt advice getting into arguments with these neighbours. If they are up in court, this process has taken years to get them there so it may be resolved soon. The council more than likely have a list of complaints as long as their arm so wouldnt proceed unless they thought they would win. A judge would recognise the lenght of time and work which goes into anti-social behaviour orders and evictions take so more than likely will judge in the councils favour. Councils have only started to be more decisive in evictions in recent years and recognise the damage that one or two families can do to areas.

my heart goes out to you and the family.

no one should be living in fear. it is not healthy or fair. and ye have children to consider which adds to yer stress like.

i think the advice given by the rest of the people are good so maybe go with them but do be careful.

and about the court thing. it is hard decision because you have to think about your family safety and then the right your family have to live in peace.

    hope it works out.

    OP...you soldier...

I really feel for you...honestly....you have my sympathies...

If you are threatened for your life and you're families, its something the council should act on immediately....

Is it rented accomodation?...IF so can the landlord not get involved?..

my previous appartment had drug dealers in and out of the place (flatmates friends) I never felt safe and the straw that broke the camels back was one night in retaliation (long story) one of them kicked the door down and hit my flatmate...

    I left the next day...

you're in the driving seat OP, they dont stand a chance..

    good luck :)

i am going through same thing [well worse]
i lived a normal life in my council home for three years then council moved the family from hell next door, they were only there there months when all hell broke out, both parents have both drink and drug problems,to cut a very long story short after many threats to myself and my two young sons ,i made complaints to council mine was not the first they recived i rang gardai got on to td,s brought a civil case against neighbours to which i won,did it stop no ,all my windows have been smashed my car damaged three times ,my life and that of my son threatened constantly, put camera on my home went back to court with prove of this bitch asking a gang of lads to kill my son for payment.she got four months she served ten days came back again .got a futher five months did not serve a day came back again.i am not the only person she has been attacking other neighbours their kids ,but they are scared just try to keep out of her way we cant we live next door, their kids were taken off them he left but she is still there five years later, again council have eviction warrant since 2006 which can not be enforced because of breach to their human rights.this has been through all the courts and still is.my advice is put in for transfare now if i knew then what i know now i would have done years ago.unless u want to go through years of hell like me dont listen to council i did or the gardai or tds to be honest not even the courts have helped this bitch has 57 previous ,i am a normal hard working person who never had any dealing with the law untill the council moved them in..i refuse to quit now i will take this all the way to much has happened.i have been failed by every state body..i will fight for my human rights the right to live in peace in my own home..
