Some people might think im nuts for suggesting this, but you would often see gangsters who get free legal aid and yet you hearing that the criminal assets would seize something worth alot belonging to them,im thinking, like in the usa and some parts of europe, shoundnt the gov use the funds from the assets seized that they judge will order that money to pay for legal aid for that person instead of the ejit taxpayer because the gangster has no "income"

Assets frozen by the CAB will still have to be proven by CAB to be proceeds from crime and so CAB nor the Government cannot spend the money as the assets are literally frozen (well not literally) so they cannot be sold. In cases that I have seen on the media the criminal prosecution of the person comes first and then dealing with any assets is done by a separate court case.

An example of this would be John Gilligan whose assets are still before the courts and hav been for nearly 10 years

Assets that are seized and proven to be the proceeds of crime are frozen for 7 years, then the CAB has to go back to the High Court to get an Order to release them, then the money gets put into the governments purse, so technically it does pay for free legal aid, it just takes a while!

You can read the Proceeds of Crime Act 1996 if you want to know everything about it.

edit: John Gilligans assets have not yet been released because of ongoing legal challenges taken by Gilligan, I'm fairly certain he lost his most recent one though in the Supreme Court.

yup he has quaver, but he played it so cunningly,he delayed the sale of his property for so long that it is not going to be worth that much now to gov, last issue of sunday independent stated that his jessbrook estate is been used now by the o.p.w to store goverment furniture
