NEED HELP URGENTLY - RESIGNING TODAY, NEED TO KNOW MY RIGHTS

    Hi there,

    I am resigning from my job today and need to know what kind of notice i need to give. I have been working here for a year but i never signed a contract of employment. Considering this, what kind of notice do i need to give? I read the contract that the girl who used to work here was given and it said that if she has worked here for over 13 weeks she needs to give a months notice. I would like to walk out tomorrow but to be fair i am thinking of giving 2 weeks. Is this ok? I dont want my employer to turn around to me with some BS about me having to give a months notice so i want to be prepared. Some people have mentioned that if you have worked there between 13 weeks - 2 years you need only give 2 weeks notice. I just want to confirm this.

    If someone could get back to me asap with an answer that would be great, i am planning on telling my boss in the next couple of hours.

    fantastic, just needed to confirm that. Also - one of the main reasons why i am leaving is that the last 2 months i have been getting paid almost 2 weeks later than i should be which is leaving me seriously out of pocket. I plan to leave on the 6th March so hopefully i will be able to get my Feb wages off my employer. I am worried that she will try not to pay me because that is what she is like - because i have not signed a contract do i have any right to demand been paid? just want to make sure i dont leave her without been paid.

    A contract can be word of mouth, it doesn't have to be a physical (or electronic) document.

    You've discussed the late payment with your employer, yes?

    Why are you just walking out? It may be that the firm is having problems getting its own money in - everyone's paying later and slower at the moment. One of the places where I work decided to pay its contractors monthly, and that turns out to mean that you're paid two months after you do any particular piece of work, rather than a week later!

    Sounds like communications aren't great in your job. Just a suggestion: ask your boss to go for a cup of coffee with you, and ask why you're being paid so much later - in an understanding and non-confrontational way, just be nice about it. Other people have their problems too.

    You may be able to work out a better deal on payment, if you explain that this is causing you big problems.

    Of course, if you really think your employer is deliberately cheating you, that's another matter.
