    Ok, Insomnia for the win! I'll try to make this short.

    Ban upheld, correctly shortened to 4 days and deserved for breach of charter, which even DB agreed since he said in the helpdesk thread "Obviously there was attitude in my reply". The (very comprehensive) charter states: Giving cheek or attitude to a moderator will get you banned. Open and shut case in that respect.

    There are some changes that will be needed and which this reinforces in my mind that we need them sooner rather then later. See below.

    Kawasaki = Paki = 7 day slap of a ban. I have lived a good chunk of my life in Dublin 1 so don't come the gombeen now with me. :) Rhetoric lawyering is useless with me. I dont listen to it for a moment.

    You say you have been here 10 years (a stunning achievement since I've been here only 8) so you should know that arguing on thread is decidedly naughty.

    Julep posted "No. If you have a problem, take it to Helpdesk". That was his entire post but you are playing the wounded soul, saying "When I asked if it was a joke, the mod turned on me ". Now, I dont think that thats "turning on you". I think you are blowing things out of proportion because you want to strengthen what you know is a weak argument.

    DB you are making yourself out to be the wounded innocent here but you and I both know you arent. You made a far snappier comment back and got booted. You expected nothing less, lets face that. It was just the kick off of this wounded-petal routine and a dose of a poormies.

    I'll address your list individually:
    (A) Labelling someone a racist and banning them.
    Upheld. The term used was racist. I dont believe the person is racist but a ban gets attention a lot faster then anything else.

    (B) Labelling a slang word racist.
    Upheld. IMHO it is.

    (C) Abusing a forum user.
    Eh? Where? Links or it didnt happen. Links, not a speech thanks.

    (D) Banning them for responding to abuse with abuse.
    You werent abused you delicate little snowflake. :)
    "No.

    is not abuse.


    (E) Falsifying and later altering the reason to ban the user.
    One fire at a time.

    (F) Proposing that arguing with a mod is worse than acts of racism.
    Upheld. Your ban was shortened as a result.

    (G) No help at the Help Desk and thread locked to prevent any.
    Locked because it was dealt with. Correctly in my opinion.

    (H) Destroying a thread to prevent further serious discussion on it.
    (I) Moving a thread to prevent further serious discussion on it.
    (taking these two together)
    That thread wasnt feedback it was a rush to the window of the Senate to appeal to the mob. It was contesting a single event, not feedback. The thread was cleaned up (I can read all deleted content you know, nothing gets hidden from me) and then dealt with in what seems to have been a reasonably efficient manner. I understand you are not happy with the outcome, but I'm not here to address your happiness, just the validity of the sanction applied.


    (J) Not responding to private messages requesting reason and help on above.

    Dude, I think you'd try the patience of Job. You wont give up or give in or take on anything people say to you. What are the possible outcomes:
    1. You get your way
    2. You get ignored

    The same way you are not going to accept my ruling despite demanding it like a stomping 4 year old.



    Now for the bit that I think needs changing. It arises from this line of thought:
    Was Julep abrupt with you?
    Yes. It certainly could be read that way. It could also just have been shortness, succinctness, consciseness or he could have been plain rushed.

    You know the rules around here so I dont feel particularly sorry for you I must admit.
    But we have a lot of new users around here and they might not get that that rule (of not back-talking a mod on the thread) is well known and strictly applied. If it wasnt every thread where someone was sanctioned would descend into a mini-replica of Feedback and go off the rails when people like you argue by volume/number of posts as much as by any form of logic.

    I dont think Julep did anything wrong because AH is a bit of a charnal-house and far too busy for lovey-hugginess and also it would be end up being a far worse asylum then it already is as a result.

    I think the only problem is the education of new users into our culture and bringing them up to speed on 8 years of evolution of the necessity of how we do things. We're going to need a Primer for new users and quite possibly some specific ones for specific forums.

    So, if you want to think of this in terms of Victory/Defeat, you can take solace in that this and some other "feedback" I've seen recently has put "New User Introduction Pack" on the list for the new Community Moderator when they arrive.

    So, thats my ruling on this. This thread has a limited lifespan, almost certainly 24 hours or less.

    All I asked was that you took a look at it. I'm glad you did.

    Some feedback.
    For clarification, I was banned for arguing with a mod, not giving cheek or attitude. Banning is something I take very seriously, as do many I would assume, so it should be done properly and accurately.
    And no julep, as I told you ages ago, I don't want you 'demodded' and you know that. I think your actions were wrong, but thanks for skewing the topic, yet again.

    Dev. Cheers for addressing the issue of my ban as the main topic of this thread, as I tried to make it clear in say... my last 20 posts about this that my ban wasn't the issue. Half a day after my ban I couldn't have given a damn as the underlying issues of this hugely used site were far more important.

    I still stand by kawasaki not being racist, especially in the way the OP used it, me auld paddy flower. It's how you say it. You, I or anyone can make anything sound racist. The OP was not being racist and the term can be deemed racist, IF YOU WANT IT TO BE.

    If I had been banned in the same manner as the OP I would have felt humiliated.
    That is the abuse of a forum user I mentioned. He wasn't addressed seriously. He deserves the same respect as everyone else.

    Kinda important, but if you're willing to overlook it, so am I.

    The reduction of my ban is yet another example of how the stick comes first with reasoning later.

    Correctly locked Help Desk thread, wtf? No way dude, but I'll leave that too.

    As for the remark of having the patience of Job. Not too sure what you mean by that, but I have a lot of patience for people, tonnes in fact, and I always count someone as a nice person first, until they prove me otherwise.

    A politely discussed resolution was what I wanted, even if the argument went against me. That's not what happened though.


    This is not a wounded petal thing DV. There were elements of that to begin with I won't deny, but that was never the reason for the thread. It was part of a ridiculous mess that was dealt with from personal views and backed up by brown nosed mods and users, who also make it difficult for anyone disagreeing with them to find any help.

    You have to see it like...
    If you think I am blowing this out of proportion you are wrong. As was said before, this site has around 200k registered users. 90% of which will take a mods word as truth. Personal views cannot cloud matters such as this and certainly shouldn't be dealt with flippantly.

    If you think additions to a charter which 90% of new users won't read will change anything, you're wrong.
    I also think that pinning me as 'one of those people' that posts quantity instead of quality is bullsh1t.

    julep in fairness broaches the subject like an adult(ish). The same cannot be said for nearly every other mod or trolling user for that matter.

    Victory or defeat...hmm.
    Victory would be an apology to meboloxitis for calling him a racist and being banned for a week. A victory would be less ban first, and more warn/explain/understanding. Victory would be more mods. Victory would be an acceptance that something is rotten in the state of boards instead of this happy family ignorance.

    This kinda sh1t can cause big trouble DeV, and honestly I was looking out for boards. Hand on my heart. Won't be the first time my advice has gone unheeded. Hopefully I won't turn out to be right, again.

    I'll leave you the last word with that. I'm not papering over the cracks but I try and see the whole picture. I mix in everything I get from every source into my head and try to spit it back out in constructive chunks with meaningful purpose.

    Some advice? If I wanted to start a thread genuinely about improving somewhere I wouldnt use a situation where I was recently on one side or other of the line to demonstrate my point. It kinda biases you from the word go, even if you are unbiased.

    Beyond that I'll try to mix in your points into my opinions where i feel you have a point. (Thats not a null set either, as I pointed out you have informed some of my thinking already). But just because the user is King, doesnt make a mod Queen.

    Lets leave it at that shall we?

    I think sometimes it takes being on one side or the other to see things in a different light and be able to form an opinion on them, be it a biased or unbiased opinion.
