Ceiling height requirement in extension?

    Was looking at a house for a friend last week. 150 year old cottage with extension built to the rear. Original cottage has low ceiling of 7'.
    Ceiling in extension is 7' also.
    Exempted development conditions say "in the case of a flat roofed extension, the height of the highest part of the roof may not exceed the height of the
    eaves or parapet. "
    However the extension must be built in accordance with the Building Regs?
    Am I right to presume that extension is not exempt and that planning should have been sought at the time ?

    It depends on the year the extension was built - the internal height of the ceiling is recommended to be 2.4m since the Building Control Act 1991.

    The exemted height you quote is an exemption from planning permission, pre 2001 / 2002 23sqm to rear was exempt, this has increased to 40sqm - subject to strict criteria.

    Its not possible to answer your questions with the info supplied, because both planning and building regs are mixed up in the question.

    I believe that the extension was built around 2001/2002 taking advantge of the increase from 23 to 40 sq.m. Ceiling height matches existing building @ 7' because "height of flat roof in extension must not exceed the eave height of original building".
    Further complicated by fact that one of the side walls of the extension was built right on the boundary with the neighbour. There are no windows on either side wall.
    I guess that retention would be required but that the selller may now claim that the LA are statute barred from taking any action after 5 years has passed.

    It's a bit complicated !
