what is the story with the crows this weather or the lack of them should I say?I managed to get up early the other morning, easy knowing I had no pints the night before, to brave the ice and the cold to do a bit decoying.I was horrid excited and looking forward to a good mornings shooting and then NOTHING!!are crows afraid of the cold or was it the light fog that was keeping them away?usually I could stand all day and shoot a steady stream of jackdaws and crows but not this time!any one else notice this?

Crows are a protected species and do not have an open season. They can only be shot when causing damage to crops, etc, etc under the derogation. Be sure that you are protecting a crop and legal under the terms of the derogation, otherwise you might be without a gun for a while and find yourself in front of a judge.:D ;)

A few questions........ Is this the same for pigeons?

Is this being enforced and has anyone been prosecuted for it yet?

If you are shooting in stubble's with the farmers permission or at his request does it count?

    Regards

The derogation does not specify that you have to be beside crops in the field...there just must be crops that are in the ground (anywhere) at that time of year, therefore it is quite alright to shoot birds (listed on derogation) on stubble

Pigeons have an open season and they can be shot until the end of January like pheasants and ducks.
There is a case where a Ranger decided that shooting Pigeons and crows over stubbles was illegal and not covered by the derogation. I haven't heard the outcome of that if it has been in court.

This is something that only a judge can determine. These cases are heard in the district courts and district courts are not capable of creating case law or precedent as they are not recorded. Therefore its up to each individual judge to determine each case on it own merits. And its open to each Ranger to enforce it as he sees fit or as their managers instruct.
It's a risky one, but one that could have you arguing your point in court. It really needs to go to the high court to be made case law. At least then it would be clear.

Sounds like a perfectly good reason to me. But surely you would need to be at the troughs to be protecting it. Shooting every crow in a 5 mile radius would be hard to justify. I'm not preaching, I'm just trying to make you aware of the risks you face.

When you say "crows" does this cover greys, rooks, magpies etc. Sorry if this sounds a little stupid but just to clarify. Also if Crows are attacking crops this time of year can they be shot?
