Road traffic accident - dangerous driving

    My brother was driving in a built up area. A council lorry crossed on to the wrong side of the road to park and struck his car. Both vehicles were moving. Guards arrived and more or less told everyone to sort it out themselves. Bro was on his own but a bystander at a bustop witnessed the incident and corroborates my brother's version of events. His car - worth about 4k is written off. No one was injured. Minor damage done to lorry.
    Problem is - he has 3rd party. He claimed from the council's insurance, driver and his mate gave statements saying they were parked when my brother struck them. Council's insurance company say that as such they have no liability, guards say it's not their job to investigate accidents. No one has approached the bystander for a statement.
    If my brother made a statement alleging dangerous driving would the guards investigate? I know there's a free phone number for this type of thing.

    I could be wrong but I think I remember that number being publicised a few years ago to combat dangerous driving but it didn't get much of a response (except for a few regular busybodies who reported anyone and everyone driving dangerously everywhere and anywhere).
    Originally it went to a dedicated call centre/office but then the just redirected it to go to your local garda station.

    But I could be wrong about the whole thing.
    No harm in ringing up to find out anyway.

    I have to jump in against my colleagues on this one. Any material damage crash which both parties agree on the events dont require Garda investigations. But if theres allegations and rebuttals then yes, they should be investigating or in a civil case, be acting as witnesses to what they saw on arrival and what both parties stated at the time.

    At this point however, I think giving your insurance company the witnesses details would do the job as he is independent and presumable, saw everything.
