I'd stick with xtra-vision, as they have a duty of care to you as the retailer. They sold you a product which does not perform as expected, so it's up to them to repair, replace or refund (in my opinion. I'm not a legal expert).

However, if you wish to contact Nintendo, they do have an excellent service through their service centre. It's a great service. My daughter had a DS on which the screen was misaligned. I contacted the service centre, they collected the DS by courier, repaired it and returned it to me by courier, within about 10-12 days. It cost me nothing, although I was told by Smyths toys (the retailer I bought it from almost 2 years earlier) that I could be charged a maximum of STG£55.

They are trying to say it looks more then a day old so they dont think it is the same console when i rang up Nintendo they told me by the serail number that my machine was only made in the last few weeks and it should not matter how much ware and tare is on it that they are build to last and then went on to say im saying this not as a nintendo staff member but as a member of the public (love when people say things like that) that i should go in to the shop and make a big scene in front of a load of people

Unless you have damaged the DS by yourself then xtra vision have to give you a replacement by law. You are well within your rigths to demand one. If they refuse you one ask to see the manager. If they don't give you a refund then it really is in bad form and you can take them to the small claims court which will win as long as the damage wasn't caused by you.

as the retailer Xtra-vision are obliged to either repair or replace (their choice) any faulty goods sold within the terms of the warranty or 24 days which ever is longer as long as it is still in the condition sold.

They must really be chancing their arm if you bought it yesterday and they are trying to suggest that it is so worn they dont believe its the same DS. Mine is more than 6 months old and apart form some tiny scratches on the touch screen is in mint condition.

Smells very fishy, going on posts on other thread.
