licence disqualified without me knowing

    Hi All,
    I arrived home tonight to find a letter from the courts stating that ive been banned from driving for one year at a court case i knew nothing about. The only connection i can make is a registard letter arrived at my home which i was not in to recieve and when i made it to the PO they had sent it back to the courts service with the postie saying it was most likely jury duty and that it would be re-sent. In respect to any offence it can only be on the mobile while driving or speeding but with both of these offences i would presume a fine and points at worst. Anyway i will call the courts service tomorrow to find out what i can do to reverse this mad situation.
    any help welcome.

    You need to file an appeal to the Circuit Court immediately. Go to your solicitor.

    100% agree.

    Also, don't want to sound like a smart-ass but obviously you shouldn't drive a mechanically propelled vehicle until the mess is sorted out, because the ban is currently operative and the last thing you want is to be creating more aggro for yourself by driving whilst disqualified.

    But I cant go without my car its my job, im holding on till 9.30 until the courts open to solve this [EMAIL="bulls@*t"]bulls@*t[/EMAIL] , must have sleept about 30 mins last night.

    Don't appeal to the Circuit court. Your disqualification holds until you get a hearing which could be 6-8 months minimum. Same thing happened to me. Get a solicitor if you dont know what your doing. But go to district court clerks office with the fine. From the case number they can detail the exact offence / original court date etc... From there you can apply to have proceedings set aside on the basis you never received a summons. When you get your hearing you can explain that you never received any summons for the original case etc.. Once granted, your disqualification will be reversed. However, the original case can be brought against you again if they want to. But you may get notice of the summons this time!!
