I bought a CD off a band's MySpace a few weeks ago. I haven't received it yet and sent a couple of emails to the contact address and heard nothing back.
I bought it via Paypal so if I don't receive the CD, is there any way to get the money back?

In paypall open a dispute and then escalate it to a claim immediately. Fill in all the details and mention that you sent mails and got no reply. If the other guy does not respond in 10 days then you win and you get your money back. If they do respond then you have to respond to them and then Paypal decides who to believe.

But I think you only get the money back if he has it in his account, if the account is empty they put a lien on it for you.

Once you open the dispute do not close it until you have your money back or the cd, if he talks you into closing it you can't file a new complaint.

There is a time limit as to when you can claim so best to file sooner rather then later.

    Hi,
Ya it is possible to get your money. If you log into your paypal account then you will see the resolution link on the top.Click it and then report the problem.

When your finished the the other person will be contacted on their paypal account to try and fix the problem and if he does'nt respond within a certain amount of time or an intermediatery is needed then a refund can be given but paypal will take a fixed fee or percentage of the cost of the item for the service.

    Hope that helps.

Thanks for the advice - if it doesn't come by the end of the week I'll get on to them.

I'm in the same boat, I ordered a PSU from ebay that never arrived. Only cost €12 but I will still open a dispute for it if the seller doesn't get back to me by tomorrow.

It's more to do the with the principle than the money as the CD was quite cheap. The good thing about ebay is you can give honest feedback.

I opened a dispute with Paypal regarding the matter. I have since received messages from the seller to say the CD will be posted - nothing has arrived yet. I got another one off him this evening to say there was a mess up with the distributor and I should definitely get it on Monday/Tuesday. I fear that he is prolonging the situation knowing that if I leave it two weeks without escalating it, Paypal will not do anything more about it.
I am unsure whether to escalate it now or wait and see if the CD arrives (I only have a few days left to escalate it).

Maybe give it to Monday/Tuesday, if you can, but escalate before you run out of time. They'll then have a further 10 days for the CD to arrive, before the claim ends and you get your money back.

Thanks for all the help, I finally received the CD. Too much hassle for buying a CD on line though, if I didn't go down the Paypal dispute route I would have heard nothing from the seller. It's online sellers like that who give online buying a bad image and make people very wary of it.
