I ordered a DVD from a website in Holland and paid by paypal. The DVD never arrived. I emailed the company and they said they will check at their end, and if it was not sent they will send one. But they said if it was posted and just never arrived, they won't send another. Can they do this? I always thought that if the customer never recieved the item they must be given a replacement or refund. If they won't send another, can I do anything?

You can start a Paypal dispute (only up to 45 days after you paid) and if the shop can't prove it was delivered, then Paypal will refund your money. If this fails, you can ring your bank and ask about a charge back for the amount that was paid, as you didn't receive the goods.

Unfortunately it's been longer than that. I paid on the 30th April. Can I still do a chargeback?

After 5 months? Possibly, but I wouldn't count on it.

It's just under 4 months. I would have done it sooner but they kept saying, wait it'll get there soon.
