If you get a ton of viruses/spyware you will probably have to remove the virues/format the drive yourself or pay someone to do it, if its legitamate applications, then no, your entitled to do that

warranties cover hardware generally, not software.

If you dont know the origin of the software though, it could very easily be malware and seriously harm your computer performance. eg. a piece of software called Anti-Spyware, on its own, would be suspect. However if it were branded properly, eg. Norton Anti-Spyware, Avast Anti-Spyware, then you'd at least know what company to look for. In this case, either norton or avast authored the software.
