N95 broke, Repair or buy a new one?

Hi, I was on a few days ago asking about how I would get my phone working, I've had no joy, and now I have to get it repaired. o2 won't cover it, because theres a scratch on the front cover, and a clip broken on the back battery cover. I called a crowd in Sandyford, name won't come to me, and they said the starting price for fixing N95's is €100(could be a lot more), which is quite steep, for what I think is a software problem. Also, they can only give a 3 months guarantee, which isn't that long.
So should I get it repaired, or buy a new one? And if so what would be the best price I could pick one up at(not Bill Pay)?
    Thanks in advance,
    Patrick

the place you're thinking of is mprc. drop it into them and don't say a word about any damage and they'll probably fix it for you for free.

they won't do a chargable repair without calling you first so you've nothing to lose

I called them, and they said that if its slightly damaged(scratch happened within 2 weeks of getting it, and same with the cover), o2 don't want to hear about it(still within the warranty, well, for the next 2 weeks anyway).
I bought a kit on eBay, to change the front and back cover(this was before my phone broke, I bought a black cover, would they say anything if I changed it?), and hope my warranty would cover it?
I am strongly considering changing it, but if I changed it, would it void the warranty?

i'm confused as to what o2 have to do with it. are you saying you called mprc and they told you o2 didn't want to hear about it? they shouldn't have any contact with o2 at all.

i dropped a phone in to mprc that had loads of scratches and i got a call three hours later to say it was fixed, no problem. just how bad are these scratches?

i wouldn't advise changing the cover. is the new one a genuine nokia case?

I was in o2, and they said they wouldn't take it in. I called MPRC, and they told me that o2 are very strict with their warranties(I presume they use my o2 warranty to claim their expenses back, understandably).
The scratch isn't that big, but its on the very front cover, beside the screen, so its very noticable. The cover I bought isn't genuine(if it was the "genuine plum" one, I put it on and send it up no bother)
I think I'll try MPRC first, and if its too expensive, I'll probably consider adverts.ie

but remember not to mention anything about paying for it until they call you and ask you to. just drop it in and leave

The unit is still in warrenty. Legally someone has to deal with it [afaik].

You purchased it from O2 so as far as I know, they are responsible for warrenty repairing it. If that is taking too long [as they WILL drag it out], go direct to Nokia.

Just because it's scratched, doesn't void the warrenty. Stick to your guns. You are in the right.

If you open it yourself any warrenty is void!

the unit is physically damaged i.e. scratch wasn't on it when purchased, so the warranty is invalidated.

surely O2 have some kind of backup chargable repair service for similar cases in order to save their customers hassle/travel problems? I'd still probably go with MPRC, they're top notch.

It's not exactly difficult for a phone to pick up a few scratches.

Is the scratch in question deep, or just a light surface scratch? I can't help but wonder if 02 are chancing their arm.

a product should be "reasonably durable". i think it's safe to say that every phone in the world that has been used for more than a week has a scratch on it and the company can't use that excuse to invalidate a warranty.

Scratches on phones are notmal wear and tear. To be honest, my understanding of O2's repsonse to your repair query is that if they have to replace your phone, they can't seel your old one as refurbished. Just because they COULD be out of pocket doesn't invalidate your warranty. The law is the law [I'm not a legal expert].

Unless it could be shown that you were unreasonably negligent in the use of your phone [dropping it from a skyscraper or dropping a brick on it], O2 haven't a leg to stand on.
