so I got myself a second hand mac mini, and it's running tiger version 10.4.11

my OH has a new macbook with Leopard 10.5.?

can i just insert her Leopard disc into my mini and upgrade...do you need a serial key like MS*? I not sure if you do, and if you dont then where's the catch ?

I take it the MacBook came with Leopard preinstalled? If that's the case, then you won't be able to use it to upgrade the Mini, because the DVD will only work in MacBooks. If you want to upgrade the Mini without violating the licence agreement, you'll need to buy a retail copy of Leopard.
