Won an Item at a bargain but other person is refusing to co operate in the deal.

    I won an "as new" item recently on EBay that was sold for well below half its retail value. The person I got it from is now refusing to co operate or acknowledge emails. I gather that it went too cheap and he is holding off hoping that I forget about it. Can I take any action against him for breaching the contract? I.e. negative points? Reporting him to EBay? Can he auction this article again? So far no money has been exchanged. How long should I wait before I follow it up?

    contact ebay straight away, if the shoe was on the other foot you won but refused to pay they would be on to ebay straight away, thats the joy of auction, the seller obviously had no reserve, you won item is yours.

    Seller non-performance is what to report. Unfortunately, you can't force them to sell it to you, but you can leave negative feedback for him not honoring the sale. He cannot leave negative feedback for you, but be honest and precise.

    Why have you not just sent the payment through? Do you need an invoice, or is there something else stopping you from paying? If you don't attempt to pay, then the seller could possibly report you as a non-paying bidder.

    It is a heavy article, ie disco lamp weighing about 20KG packed. postage not confirmed, this is what I am waiting for.

    Did it state in the auction that he would post to Ireland? If he did, then you are in the right. If he didn't, then he could get out of selling to you on this grounds.

    He did state that overseas purchasers should contact him first. I also use an Northern Ireland address as I have a Brother living there. Carriage from the UK to NI is considerably cheaper than from UK to Eire and would be similar or not much more than as if he was posting to Scotland or Wales so I could not see that as a problem.

    He also stated that he would expect a week to clear any checks if I was not using Paypal and idealy said he would prefere a c.o d. I told him that I would be prepared to have it collected in London by a mate if he was reluctant to post it.

    Did you actually bid on an item without knowing what the postage would be?

    They can now basically quote whatever they want. How much would you be expecting to pay for P&P. I see it is ~€100 to post 20kg with an post to the EU.

    On a lot of items I buy postage is more than the item, crazy to be bidding without knowing the postage.

    If the postage comes to over 80STG I either get a mate to collect it in the UK and get it back here in my own time or else get them to foreword it on to NI. In some cases if I want it sooner it is worth taking the boat over and making a weekend out of it. PA equipment is heavy particularly amplifiers and speakers which could weigh in excess of 60KG! I always take postage into consideration before any purchase as often it can add up to more than the article would be worth if purchased new.
