I'm being paid LESS than the minumum wage!

    Hey everyone,

    At the moment, I'm working part-time (23hrs per week), and I've checked the last few payslips, done the maths, and found that I'm being paid precisely 8.45 per hour, instead of the minimum wage, which is 8.65 per hour. Can anyone explain?

    There are exemptions; see link above to check


    tbh they are paying you so close to the wage Its hard to think its some deliberate attempt to underpay staff, perhaps just an error or your sums are a little off?

    Did you perhaps forget a break which is unpaid but you think it was paid(23h sounds as an odd amount of hours)?

    Are you under 18 or could you be considered inexperienced at the job you are doing?

    These are commonly used reasons to undercut on minimum pay.

    No, I'm and experienced adult worker and I'm entitled to 8.65. So there are no other exceptions then?

    Afaik, minimum wage is €8.91 now. However I was only getting paid €6.92 an hour after 3 years working in a supermarket due to certain stupid exemptions which my employer took full advantage of.

    You have to have 2 years experience after turning 18 in certain areas to be entitled to adult min. wage. I don't know if this applies to you or not;)

    Like a previous poster said, is the 23 hours including or excluding breaks?

    Just say it to your employer, I doubt it's a deliberate attempt to screw you over, if they don't rectify the problem take it further, but just make sure you're in the right first.

    I worked in my job for a year when i was 16 getting 6Euro an hour then when i turned 17 they put me up to 7Euro an hour and now that im 18 they only paid me 7.79Euro per hour so i decided to stand up for myself and i managed to get a pay rise to 8.20Euro and my big boss wont pay me 8.65 till i turn 19??
    Now seriously wtf, like im experienced and Ive worked there for years probably cause I was too quite or pathetic to move on to another job but now Ive seen the light and also i want more money! What on earth should i do I mean how on earth can a man be that stingey with money!
    Any advice anyone? Theres only two months left or so till summers over, sorry to point that out but I need to decide soon.
    I could go to the courts i know but thats effort when i could just get a better job...

    There are a few exceptions you need to be aware of.

    Minimum wage is for someone OVER the age of 18 with one years RELEVANT experience since turning 18.

    So, say you are working on a till and are aged 18, you are not entitled to it. Whether you get it or not is up to the employer.

    If you are 18 and have worked on the till since age 16, the clock starts ticking only on your 18th birthday. Experience before that birthday is not counted. So you are not entitled to it until your 19th birthday.

    The other thing you have to consider is whether you have RELEVANT experience. One year working on the deli does not count as experience on the till. It is difficult to define RELEVANT. You need to post more details about your experience or feel free to PM me.

    Under Age 18 (note restrictions may apply to number of hours worked)
    €6.24

    First Year of first employment over age 18
    €7.13

    Second Year of first employment over age 18
    €8.02

    Experienced Adult Worker (i.e. with two years service per above)
    €8.91

    Experienced Adult Worker with one years addtional service
    €9.00

    Experienced Adult Worker with another one years additional service
    €9.19













    Examples:

    1) Employee aged 18yrs 4 months (first employment) – Starting rate €7.13. After one year’s service (i.e. age 19yrs 4 months) moves to €8.02.

    2) Employee aged 21yrs 2 months (direct from college – no experience previously) minimum rate is €7.13 and on first anniversary (i.e. 22yrs 2 months) rate is increased to €8.02.

    3) Employee with 4 years prior experience and 23 years of age and rate from last employer is €9.19 – minimum rate for new job is €8.91 – reason: because it is not first employment the two lower rates of €7.13 and €8.02 do not apply and because an employer does not have to give credit for the incremental service (i.e. years 3 and 4) the upper two rates do not apply.

    Of course to recruit and retain quality staff each employer must review the market conditions to determine what is the rate they are willing or required to pay to employ their staff.

    well ive only one years experience working on the till i suppose! well Im happy with my new raise now i couldnt ask for anymore at the moment but if something better comes along I dont think il pass it again!

    Stupid laws theres so many loop holes that young people just aren't aware of. Then they're going into most of these jobs with lack of knowledge and high hopes which their employers are well aware of!

    Where did you get this from? This isn't something I've seen in any available information, which simply refer to "first and second years from dates of first employment". Which wouldn't even require you to be working continuously during those two years. There are exemptions for people in training, but this only applies to structured training.

    the first and second year thing is debateable but i thought min wage hasn't gone up since july07
